2024 – Maharashtra’s real estate sector has reached a significant milestone with the issuance of MahaRERA Circular No. 63, marking a transformative moment for real estate agents across the state. The circular mandates the inclusion of Clause 15A in the Model Form of Agreement for Sale and the Allotment Letter, ensuring official documentation of agents’ brokerage. This step ushers in a new era of transparency and accountability in property transactions throughout Maharashtra.
Pramod Vyas, Vice-Chairman of RERA, NAR-India, stated, “The issuance of Circular No. 63 is a victory for all real estate agents who have long sought the recognition they deserve. This decision not only protects their rights but also encourages the development of a more transparent and trustworthy real estate ecosystem.”
Amit Chopra, President of NAR-India, expressed his enthusiasm for the reform, stating, “Circular No. 63 is a monumental step forward for real estate agents in Maharashtra. It not only ensures fair treatment and recognition for agents but also fosters a more ethical and transparent real estate environment. This is a win for everyone involved—agents, promoters, and buyers alike—and sets a new standard for professionalism in the industry.”
The issuance of this circular marks the culmination of 1.5 years of relentless efforts by MahaRERA and NAR-India’s first Agents Self-Regulatory Organization (SRO), which has been unwavering in its pursuit of fair recognition for real estate agents’ contributions to the industry. Through consistent advocacy and collaboration, the SRO has worked to ensure that agents are acknowledged not just as intermediaries, but as integral players in the real estate ecosystem. Their efforts have paved the way for this significant regulatory shift, aimed at promoting transparency and fairness in the market.
The Involvement of Mr. Manoj Saunik as MahaRERA Chairman was instrumental in bringing this long-awaited reform to fruition. His leadership and commitment to driving positive change for the real estate sector accelerated the implementation of Clause 15A, addressing a long-standing demand for formalizing the role of agents in property transactions. This combination of dedicated advocacy and decisive leadership has resulted in a much-needed breakthrough for the industry, benefiting agents, promoters, and consumers alike.
Clause 15A brings several key benefits to Maharashtra’s real estate sector, starting with enhanced professional recognition, as it formally acknowledges the vital contributions of real estate agents, thereby strengthening trust and credibility in the industry. It also establishes a stronger legal framework by embedding agents’ rights in formal agreements, providing a solid foundation for fair enforcement practices. Additionally, the clause ensures greater promoter accountability, requiring promoters to adhere to higher ethical standards and fulfill their commitments to agents. Finally, it promotes professional development by recognizing agents’ expertise, encouraging continuous growth and skill enhancement within the profession.
This landmark decision underscores the pivotal role that real estate agents play in Maharashtra’s property market, acknowledging their contributions as essential to the industry’s success. By formalizing the recognition of agents’ efforts and implementing transparent processes, this move strengthens the foundation for a more equitable marketplace. It promotes a professional environment where agents are not only fairly compensated but also empowered to operate with greater trust and accountability. As the industry embraces these changes, it sets a new standard for ethical practices, fostering a more robust, credible, and sustainable real estate sector in Maharashtra.
